1. Acceptance of Terms

By accessing or using Scaffly ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Scaffly is an AI-powered tool that generates visual designs for mobile applications from text descriptions.

3. User Accounts and Subscriptions

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the Service. Subscriptions are managed through our billing partner. You are responsible for maintaining the security of your account credentials.

4. Acceptable Use

You agree not to:

• Use the Service to generate illegal, harmful, or offensive content
• Attempt to reverse-engineer or extract the underlying AI models
• Use automated tools to send excessive requests beyond normal usage patterns
• Resell or redistribute generated outputs as a competing service
• Violate any applicable laws or regulations while using the Service
• Exploit, probe, or attempt to exploit any vulnerabilities, bugs, or security weaknesses in the Service, including but not limited to: unauthorized access to accounts, data, or systems; injection attacks; authentication or authorization bypass; privilege escalation; data exfiltration; or any other action that could compromise the integrity, availability, or confidentiality of the Service

If you discover a security vulnerability, you agree to report it to us promptly at [email protected] rather than attempting to exploit it. We appreciate responsible disclosure and will work to address reported issues promptly.

5. Intellectual Property

You retain ownership of the mockups and designs generated through your use of the Service. Scaffly retains all rights to the platform, technology, AI models, and underlying intellectual property. The Service itself, including its design, code, and branding, remains the property of Scaffly.

6. AI-Generated Content

Outputs are created using third-party AI models. Scaffly does not guarantee the uniqueness, accuracy, or fitness for any particular purpose of AI-generated content. Generated mockups are provided "as is" and may require human review and modification before production use.

7. Payment and Refunds

Subscription billing is handled by our payment partner as Merchant of Record. They manage all payment processing, invoicing, and applicable taxes. Refund requests are subject to their refund policy. Please contact support if you have billing questions.

8. Screen Credits

Each screen generated consumes one credit from your monthly allowance of 40 screens. Credits are deducted at the start of each generation request, before AI processing begins.

Generating multiple screens in a single request deducts one credit per screen (e.g., 4 screens = 4 credits). Regenerating or modifying a screen costs 1 credit.

Credits consumed by failed, incomplete, or canceled generations are non-refundable, as computational resources are consumed regardless of outcome. Unused credits do not roll over between billing periods.

9. Limitation of Liability

To the maximum extent permitted by law, Scaffly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms. You may cancel your subscription at any time through your account settings. Upon termination, your right to use the Service ceases, though previously generated content remains yours.

11. Changes to Terms

We may update these Terms of Use from time to time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.
